This Notice is issued pursuant to the requirements of the UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data and the regulations applicable to the Ras Al Khaimah Digital Assets Oasis (RAK DAO). This notice is issued in English. In the event of any translation, the English version shall prevail.

This notice also adopts and incorporates our terms as contained in our Privacy Policy (hereinafter referred to as the "Privacy Policy"). In the event of any inconsistency between the Privacy Policy and this notice, the terms as contained in the Privacy Policy shall prevail.

By using our Services (as defined in our Terms and Conditions), you agree to the terms herein and to any additional rules and guidelines that we post subsequently. We may make changes to this notice from time to time and we may notify you of such changes by any reasonable means, including by posting the revised version of this notice on our website or mobile application. Your use of our Services, website or mobile application following changes to this notice will constitute your acceptance of those changes; provided, however, any material change to this notice shall not apply retroactively to any claim or dispute between you and us in connection with this notice that arose prior to the "LAST UPDATED" date applicable to that version of this notice in which we included such material change.

1. Key Information

The company responsible (the Data Controller) for any personal information that we may hold and process is f5 Group Ltd (Registration No. 01010914), a company incorporated in the Ras Al Khaimah Digital Assets Oasis, United Arab Emirates. f5 Group Ltd is the operator of all services and any related mobile software applications made available by us.

2. What Information Do We Collect?

Personal information means any information that may be used to identify you as an individual, including but not limited to:

  • (a) First and last name;

  • (b) Email address;

  • (c) Home, postal or other physical address;

  • (d) Other contact information;

  • (e) Title;

  • (f) Date of birth;

  • (g) Gender;

  • (h) Nationality and country of residence;

  • (i) Government-issued identification documents (for KYC purposes);

  • (j) Digital asset wallet addresses; and

  • (k) Financial information required for transactions.

We may also collect other information to provide a quality personalised service to you such as occupation, industry, personal interests and preferences.

In addition to personal information provided, we also collect and use anonymous data from your internet browser and device using cookies, service logs, third-party website analytic companies and other similar technologies. We use this information to help us understand how our services are used so that we may consider how best to improve them and also so that we can provide more relevant content to you.

We may also collect personal information when you use certain services provided by us, when you register to attend an event organised by us, when you request marketing information, or when you participate in one of our surveys, competitions or promotions.

From time to time, we may receive personal information from business partners and vendors where such parties have gained your consent to do so. In such cases, all personal information will be treated as confidential information as outlined within this notice.

3. What Do We Use the Information For?

We may use your personal information for the following purposes:

  • (a) To assist in providing our services to you;

  • (b) Where it is necessary for our legitimate interests;

  • (c) To comply with regulatory requirements under UAE law, including KYC and anti-money laundering obligations;

4. How Do We Share Your Information?

We will not sell any of your personal information to third parties.

We may only share your personal information with other companies for the sole purpose of improving our services or providing our services to you. These companies may include:

  • (a) Other entities managed by f5 Group Ltd, subsidiaries or holding companies;

  • (b) Payment service providers;

  • (c) Identity verification and KYC service providers;

  • (d) Professional advisors (lawyers, accountants, auditors);

  • (e) Any of our employees, agents, suppliers or subcontractors.

We will also disclose your personal information if required to do so by law, to enforce our Terms and Conditions and services provided, or as needed to fulfil contracts in place. In urgent circumstances, personal information may also be disclosed where it is required to do so to protect personal safety.

Personal information may be shared outside of the United Arab Emirates in accordance with the cross-border transfer provisions of the UAE Data Protection Law, ensuring appropriate safeguards are in place.

5. How Do We Protect Your Information?

We take the security of your personal information extremely seriously. We safeguard the security of the personal information you send us through:

  • (b) Electronic security measures including encryption and secure socket layer (SSL) technology;

  • (c) Access controls and authentication requirements;

  • (d) Enforcement of management procedures and staff training; and

  • (e) Regular security assessments and monitoring.

6. How Long Do We Keep Your Personal Information?

We retain your personal information for different durations based on the type of information and purpose for which it was provided and was being or is being used in order to provide information or services to you.

We will retain your personal information for as long as necessary to:

  • (a) Provide our services to you;

  • (b) Comply with our legal and regulatory obligations under UAE law;

  • (c) Resolve disputes and enforce our agreements; and

  • (d) Fulfill any other purpose for which the information was collected.

When the information is anonymous (as collected or made anonymous through processing), we may retain the information for longer periods for trend analysis and statistical purposes.

When personal information is no longer required for any permitted purpose, we will destroy or permanently de-identify such information in accordance with the UAE Data Protection Law.

Under the UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data, as a data subject you have the following rights:

  • (a) Right of Access: You may request a copy of the personal information held on you.

  • (b) Right to Rectification: You may request that inaccurate or incomplete information is corrected.

  • (c) Right to Erasure: You may request that some or all of the information is deleted, subject to legal retention requirements.

  • (d) Right to Restrict Processing: You may request restriction of processing in certain circumstances.

  • (e) Right to Data Portability: You may request to receive your personal data in a structured, commonly used format.

  • (f) Right to Object: You may object to processing for direct marketing purposes.

  • (g) Right to Withdraw Consent: Where processing is based on consent, you may withdraw your consent at any time.

We may not be required to give you access to your personal information in certain circumstances as set out in the UAE Data Protection Law, including where it may have an unreasonable impact on another individual's privacy. If we refuse access for such reasons, we will advise you in writing of the refusal and our reasons and the complaint mechanisms available to you.

8. Is My Personal Information Accurate?

You are responsible for ensuring that the information you provide to us is accurate, complete, not misleading, and kept up to date.

If you believe that any personal information we hold about you is inaccurate, incomplete, or out of date, please contact the Data Protection Officer to request correction. We will take reasonable steps to correct any information found to be inaccurate, incomplete, or out of date.

9. International Data Transfers

Your personal information may be transferred to, and processed in, countries other than the country in which you are resident. These countries may have data protection laws that are different from the laws of the UAE.

Where we transfer personal data outside the UAE, we will ensure that appropriate safeguards are in place in accordance with the UAE Data Protection Law, including:

  • (a) Ensuring that the recipient country provides an adequate level of protection; or

  • (b) Implementing appropriate contractual safeguards.

10. Legal Basis for Processing

For purposes of the UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data, the processing of your personal information is supported by the following lawful bases:

  • (a) Consent: You have given consent to the processing of your personal data for one or more specific purposes.

  • (b) Contract: Processing is necessary for the performance of a contract with you or to take steps at your request before entering into a contract.

  • (c) Legal Obligation: Processing is necessary for compliance with a legal obligation to which we are subject under UAE law.

  • (d) Legitimate Interests: Processing is necessary for the purposes of legitimate interests pursued by us, except where such interests are overridden by your interests or fundamental rights and freedoms.
